Welcome to Premium Fencing and Outdoor. These Terms of Service govern your use of our fencing, retaining wall, and gate installation services in Melbourne. By engaging our services, you agree to be bound by these terms. Please note that this document is a template for informational purposes and does not constitute legal advice.
We agree to provide the fencing or outdoor services as specified in your itemised quote. Any changes to the scope of work ie. the customer changes their mind on colour/design or make any changes after agreeing to the works, this will be classified as a variation and subject to variation charges. We always follow the land level. If clients wants the job in one level they have to let us know.
The client is responsible for ensuring clear access to the site (ie. free of obstructions, including animals) and identifying any underground services or boundaries and responsible for obtaining necessary permits prior to commencement of works. All care will be taken when on site, but we do not take responsibility for damage to underground cables, pipes or damage to the garden.
A 50% deposit is required to secure your booking and order materials before commencement date. Final payment is due immediately upon practical completion of the project. Late payments may incur administrative fees as permitted under Australian Consumer Law.
Fences/Gates/Retaining walls remains the property of PREMIUM FENCING AND OUTDOOR until full payment is made. Premium Fencing and Outdoor has got the right to remove the fence if payment is not fully paid.
Cancellations made after materials have been ordered may result in the forfeiture of the deposit to cover costs. Refunds for labor will be assessed based on the stage of completion. We comply with all Australian statutory refund rights regarding major failures of service.
We stand by the quality of our craftsmanship. Our services come with guarantees that cannot be excluded under the Australian Consumer Law. Additionally, specific materials may carry manufacturer warranties which we will pass on to you upon completion.
Premium Fencing and Outdoor provides a 12-month workmanship guarantee on all installations from the date of completion. This guarantee covers structural defects resulting from the installation process itself. Please note that warranties for materials (such as Colorbond steel, timber, or gate automation systems) are provided directly by the respective manufacturers and are subject to their specific terms. This warranty does not cover damage caused by extreme weather events, ground movement, or lack of reasonable maintenance by the customer.
To the maximum extent permitted by law, Premium Fencing and Outdoor is not liable for indirect or consequential losses. We are not responsible for damage caused by ground movement, extreme weather events, or client-provided information regarding site boundaries and underground utilities.
All designs, photos of completed work, and website content are the intellectual property of Premium Fencing and Outdoor. We reserve the right to use photos of completed projects for marketing purposes unless otherwise agreed in writing.
These Terms of Service are governed by the laws of Victoria, Australia. Disputes arising under these terms shall be subject to the exclusive jurisdiction of the courts of Victoria.
